The 3DS may just be the final retail name for Nintendo's console, with the Japanese giant trademarking a few 3DS-related terms.
Despite continually reminding us that the "3DS" is a working title and not the console's formal name, Nintendo seem to be taking steps to protect the concept whether or not "3DS" becomes the final name by popping off a few terms in the ol' trademark database.
According to Siliconera the company has added "3DS, N3DS, 3DSPlay and 3DSWare" - suggesting that there might be a Wii Play-esque title that would presumably introduce the new 3D mechanics to players, as well as a continuing download capabilities on the handheld.
Nintendo seems set to continue the "DS" concept too, with various other trademarks popping up in the Japanese database - "DS Sound, DS Name Card, DS Magazine, DSMovie, DSCamera, DSCinema, DSMessage, DSMusic, and DSAlbum". Again it's not certain whether Nintendo will use any of these.
