If Microsoft and Nintendo agreed to have GoldenEye on both XBLA and VC, I really don't think either would lose out too much. It'd be a win-win for both companies...

Jesusraz, isn't the James Bond gaming rights owned by EA, so they'd also have to give the ok.
Oni, emulation is illegal. Even consoles require drivers and these are the property of the part manufacturers. For emulation to work it has to copy the internal software and create a virtual shell within which the game runs. On windows they use Windows certified drivers which is available to all windows users but for console games those drivers are not a part of windows and hence you have no legal rights to use them on a Windows platform without the express permission of the software owners. So emulation on a windows platform of a console that doesn't have windows drivers is illegal and the same applies to consoles.
Activision now holds the gaming rights until something like 2012...Also, MGM Studios would have to agree to it as well. So there are five parties involved, I think:
Nintendo - publisher
Rare - developer
Microsoft - owner of Rare now
Activision - licensee of Bond games
MGM - owner of Bond overall
